It sets two cookies on wastify.co.uk and Microsoft sets its own on clarity.ms. Microsoft handles that data under its own privacy statement, which may involve processing outside the UK. Nothing here is shared with an advertising network.

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Wastify AI Limited (“Wastify AI,” “we,” “our,” or “us”) governing your access to and use of our website, products, services, and software (collectively, the “Services”).

By accessing or using the Services, you affirm that you have read, understood, and agreed to these Terms. If you do not agree to these Terms, do not use the Services.

1. Definitions

  • Services: All products, software, tools, websites, applications, and features provided by Wastify AI.
  • Content: All text, images, data, reports, code, and other materials provided through the Services.
  • User Data: Any data or information submitted by you in connection with your use of the Services.
  • Account: A registered user profile enabling access to certain Services.

2. License & Restrictions

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services solely for lawful business purposes, in accordance with these Terms. Any unused credits, fees, or balances will automatically expire upon termination or expiration of the contract and cannot be rolled over, refunded, or carried forward.

You may not:

  • Copy, modify, distribute, sublicense, or reverse engineer any part of the Services.
  • Access or use the Services for illegal or unauthorized purposes.
  • Use automated tools (bots, scrapers, etc.) to access the Services without our consent.
  • Interfere with the integrity, security, or performance of the Services.

3. Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of unauthorized use or security breaches.

We reserve the right to suspend or terminate your account with one (1) day’s notice if we detect misuse, illegal activity, or conduct detrimental to Wastify AI or others.

4. Fees & Payment

All payments to Wastify AI are non-refundable under all circumstances. Any amounts paid are deemed earned upon receipt. You agree to pay all fees as specified in your order or contract.

5. Service Availability

We strive to maintain high availability of our Services but do not guarantee uninterrupted, error-free performance. We may modify, suspend, or discontinue any Service at any time without liability.

6. Data & Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. That notice, and not these Terms, governs how we handle personal data, and it sets out the lawful basis we rely on rather than treating your use of the Services as consent.

7. Intellectual Property

All intellectual property rights in the Services and Content remain the exclusive property of Wastify AI or its licensors. You may not use our trademarks, logos, or proprietary content without prior written consent.

8. Third-Party Services

The Services may include integrations with third-party products or services. We are not responsible for the content, policies, or practices of these third parties. Your use of such services is at your own risk and subject to their terms.

9. Export Control & Compliance

You agree to comply with all applicable export laws and regulations and not to use or export the Services in violation of such laws, including to embargoed countries or restricted parties.

10. Disclaimers

The Services are provided “as is” and “as available”. Except as expressly stated in these Terms, in a Master Services Agreement or in an order form, and save for any term that the law does not allow us to exclude, we exclude all warranties, conditions and other terms implied by statute or common law, including as to satisfactory quality, fitness for a particular purpose and non-infringement.

We do not warrant that the Services will meet your requirements, operate without interruption, or be error-free.

11. Limitation of Liability

To the maximum extent permitted by law:

  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow us to exclude or limit. Subject to that, our total liability to you for any claim shall not exceed the total amount you paid to us in the preceding twelve (12) months.
  • We shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of data, revenue, or business opportunities.

12. Indemnification

You agree to indemnify, defend, and hold harmless Wastify AI, its affiliates, officers, and employees from any claims, damages, liabilities, or expenses arising from your use of the Services, your breach of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Services at our discretion, with one (1) day’s notice if we identify misuse, breach of Terms, or harmful conduct. Upon termination, your right to use the Services ceases immediately.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms.

Nothing in these Terms limits your right to bring a claim in those courts.

15. Force Majeure

We shall not be held liable for any failure or delay caused by circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, strikes, government actions, or internet disruptions.

16. Severability & Waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right or provision does not constitute a waiver.

17. Entire Agreement

These Terms, along with our Privacy Policy and any additional agreements you enter with us, constitute the entire agreement between you and Wastify AI regarding the Services.

18. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with the revised effective date. Your continued use of the Services constitutes acceptance of the updated Terms.
